At A time when citizens demand accountability to the State before the Justice, the fact that it is made by human beings, is operated by the government undermined. The through is not new.
The health crisis gives us a beautiful illustration in an application for interim measures-suspension launched by a group of citizens, doctors and associations against the regulatory acts taken by the Government to prevent doctors from prescribing the hydroxychloroquine, azithromycin and, more generally, the anti-viral for patients with the COVID-19.
The appeal was filed on June 19, 2020, the Prime minister has sent his observations on 3 July 2020, under the terms of a letter signed by the Director of legal affairs[1], Mr. Charles Touboul, whose career at the Council of State is exemplary. He has held the positions of the most prominent (rapporteur, deputy general public rapporteur and spokesperson for the Council of State) between 2012 and 2019[2]. This CVS snoring has earned him the promotion to chief legal officer at the ministry of social Affairs in August 2019[3].
It seems a little embarrassing that the Prime minister be represented before the Council of State by Mr. Touboul, which was no other, there are still a few months, as the spokesperson, the superior and the colleague of the judges who would be called upon to pronounce on the merits of the request for suspension of the prohibition of the prescription of these older drugs become controversial.
If one dared, one would speak of another form of conflict of interest.
