According to the indictment, Nečas twice testified falsely in court in the case of misuse of Military Intelligence, which contributed to the fall of his government in 2013. It was then revealed that Nečas' then-lover and head of his cabinet, Nagyová, had illegally ordered reporters to monitor the prime minister's first wife, Radka, as well as two employees of the government office. Based on Nečas' statements from April 2015 and September 2017, the court initially acquitted the woman repeatedly. In the end, the judiciary punished her with the strictest possible suspended sentence and the maximum – i.e. ten-year – ban on working in leading positions in the state administration.
Nečas denies guilt. He insists that he was telling the truth in the case of misuse of Military Intelligence. He stated that he asked Nagy to provide him with the help of informants because he felt concerned for his safety. However, the courts came to the opinion that Nagyová was the sole initiator of the surveillance, who wanted to use the information obtained for personal gain. The district court for Prague 1 imposed a sentence on Nečas in the form proposed by the public prosecutor. He set a two-year probationary period for the ex-prime minister.
Before the end of his mandate, former president Miloš Zeman granted Nečasová a pardon, pardoning her for the rest of the probationary period. He justified it by the passage of a long time since the act was committed and by Nečasová's regular life. At the District Court for Prague 1, Nečas and his wife are also facing indictment in the case of alleged bribery of ODS deputies.
