The déconfinement has led companies to adopt new measures for the protection of health. Employees are required to comply under penalty of sanctions.
Since Monday, may 11, France has entered a phase of déconfinement progressive. If the government has called on the companies and the employees to maintain the telework when it was possible, the employers have however the obligationto ensure the safety of their employees and all visitors (vendors, customers, partners, …).
New rules for the internal regulations of each company
It is for the companies to ensure strict respect of the gestures barriers. The hydroalcoholic gel, masks, gloves, protective shields, …. Each company has been able to adopt specific rules for the protection of health, including by imposing the wearing of the mask to each of its employees and / or the port of the mask.
In pursuance of the conditions of the State of public health emergency, the internal regulations of the company may then be changed without waiting the prescribed time limits, requiring all employees to comply with these new constraints.
What penalties for employees not complying with the protection measures
In accordance with the labour law, non-compliance of these rules by an employee may result in disciplinary action. All sanctions are possible, the warning procedure of dismissal for serious misconduct (endangering the safety of other employees, customers, …).
It will be up to the company to provide evidence of this non-respect of security rules, if the procedure was challenged by the employee concerned.
