Prague – The Municipal Court in Prague rejected the lawsuit against the building permit for subway D. Only a cassation complaint can be filed against the decision. Adam Scheinherr (Praha Sobě), the acting deputy mayor, told ČTK today. The lawsuit was filed by opponents of the construction from the association Pankrácká společnost in response to the decision of the Ministry of Transport, which rejected his appeal against the issuance of the permit.

Last year, in the second half of April, DPP started the construction of the section from Pankrác to Olbrachtova Street, which will be followed by the section to Nové Dvory. The section from Nové Dvory to Depo Písnice will be the last to be built. The total costs should tentatively be 52.09 billion crowns when inflation is taken into account.

“The lawsuit was filed by Pankrácká společnost and today the court rejected it in its entirety. The judgment will be drawn up within 30 days. Now there is no appeal against it, one can only file a cassation complaint with the Supreme Administrative Court,” said Scheinherr.

If the court were to grant the lawsuit, it would mean that the transport company (DPP) would have to stop all work, preserve the building and obtain a building permit again. This would not only delay the construction, but also make it more expensive. According to Scheinherr, it could be in the range of hundreds of millions of crowns to billions.

The lawsuit was filed by the Pankráck company in May 2022, but it had procedural errors, it was delivered to the wrong court. The association filed several complaints against the construction, including accusing the municipality of systemic bias, which the Ministry of Transport subsequently rejected. It also dealt with a complaint against the issuance of a building permit from the same complainants. The Antimonopoly Office also dealt with a complaint about a tender in which the DPP selected the construction contractor. This complaint was also rejected.

Preparation for the construction of metro D faced a number of problems. The city had to come to an agreement with the landowners along the planned route. All parties reached an agreement in 2019.

DPP is now selecting a builder for the construction of the second section of metro D from Olbrachtova to Nové Dvory from three consortia, which consists of 16 companies from five countries. He plans to announce the winner of the tender by the end of March 2023 and start construction in the second half of this year.
