Medical cannabis

On Friday, the government, through a decision from the Ministry of Health, organized the operation of the cannabis registration system (Reprocann), whereby “medical cannabis users” can “register” individually through a representative and obtain permission to cultivate, to access agriculture through a third person (farmer) Or through a civil organization licensed for this purpose. “

The decree, which carries the number 800/2021, also provides for the abolition of Ministerial Resolution 1537 of September 21, 2017, which created a more restrictive regulation of the Medical Use of Cannabis Law (27350) and which was repealed with effect from the new law. That were sanctioned in November 2020.

Going forward, Reprocann has registered “users accessing the hemp plant and its derivatives, as medicinal and / or therapeutic and / or pain reliever therapy, through controlled cultivation” which will allow them to cultivate or access agriculture through farms or organizations authorized for this purpose.

How is the system

From Health, it has been determined that the system enrolls users with a medical diagnosis and indication so that they can access controlled cannabis cultivation as a medicinal, therapeutic and / or pain reliever treatment.

The regulations state that “Users who access the cannabis plant and its derivatives, third-party growers and treating physicians must have a current user on the Argentina.gob.ar platform,” while the permission obtained through the registration will be valid for one public person.

To request this registration, which can be made at https://reprocann.salud.gob.ar, it is an “exclusive” requirement that you have medical evidence of the use of cannabis and its derivatives by a medical professional.

The coordinator of the National Program for Research on the Medical Uses of Cannabis, Marcelo Morante, explained that “The decision came as a response to the insufficiency of Article 8 of Law 27350, in order to expand or protect individual rights so that anyone who needs a curative culture and medical observation can do so under a permit from the Ministry of Health in the country.”

Annex 2 authorizes the decision to grow between one and nine flowering plants, in an area of up to six square meters indoors (outside cultivation is not permitted) and between 1 and 6 bottles of 30ml or up to 40ml that can be transported. Grams of dried flowers.

According to Ministry of Health sources, “Indoor cultivation consists of cultivation under controlled conditions, and this means protection from extreme weather, soil and pathological conditions for plants. In this way, control of variables is achieved and allows for a safer and more predictable medicinal product.”

On the other hand, they cautioned against “not to confuse (internal) with the term indoor, which refers to a covered crop, indoor cultivation does not necessarily refer to mulching but to controlled conditions.”

Reprocann, as created from this resolution, is in line with new regulations for Law 27350 that the nation’s president approved in November of last year.

Decree 883/2020 extends beyond refractory epilepsy, creating the conditions necessary to allow self-controlled transplantation and to keep many families in our country from hiding; It also guarantees the provision of treatment to patients, and encourages public and private research and production of oil and its other derivatives.

On the one hand, the Ministry of Health is working with the National Seed Institute (Inase) and the National Medicines, Food and Medical Technology (Anmat), jointly to ensure safe, good and fair access for Argentines. Who needs it.

Support from organizations

Mam Cultiva NGOHeaded by Valeria Salish, she also expressed satisfaction with the decision and considered that “It is another step in the long road to the struggle for plant freedom and our right to health. “

“This decision poses challenges and opportunities for improvement, especially with regard to conditions for access to agriculture and the need to train doctors to refer to cannabis.” They emphasized that “we have a lot to contribute to, because we are organizations and people who grow in solidarity and who have responded to society’s demand for fair and comprehensive access to Planting, Through Self-Cultivation, Solidarity Cultivation and Network Cultivation. “

Finally, Salk added, “We continue to work collectively towards better legislation and the integration of cannabis treatments into the health system.”

“We welcome the registration that has started recently,” Pablo Fazio, president of the Argentine Cannabis Chamber (Argentine), told Talam.

He added, “Another step forward through a progressive take-off,” stressing that “the achievement belongs to the organizations and activists who have been active in this issue.”

Fazio explained that this measure “will stimulate a series of activities by many members of the room, such as selling supplies, feeders for planting, lighting systems, indoor tents, etc.”

“From a commercial point of view, the main beneficiaries of legalizing the activity will be hundreds of growth shops, which represent the main sales channel for these products,” he added.

For these preemptive comments on Reprocann’s creation, Sebastian Basalu, editor of THC, Dedicated to news and cannabis cultivation, celebrated that “the government has finally made it clear that in the new regulation for autotransplantation for medicinal purposes it will be possible to cultivate outdoors, because limiting medicinal autotransplantation to the“ indoor ”method will have it unrealistic, unfair and very disturbing, because most users Medicines are grown abroad and they will still be criminals or forced to resort to the black market. “

“It’s great news that the national government has launched the registry so that people who grow medicinal cannabis for themselves or other drug users enjoy legal protection, not only in terms of farming but also in terms of possession of cannabis on the public road,” he explained.

Finally, he added, it would be “a key for the government to protect the private data of people who register on that registry.”
