Wendy’s supervisor now spends two years behind bars in a Sydney restaurant with her teenage co-worker.
David Lennard MacDonald, 25, was taken by the sheriff of court after attending provincial court on Friday.
A Sydney man’s two-year prison sentence is more than double what was recommended by both the Crown and the Defense.
Judge Dan McRae said harsh punishment was necessary if the facts of the case were addressed.
“He abused his position of trust against five different victims,” said Macri. “The duration of their crimes is more than a year. Attacks by the accused are planned and deliberate in the area [were] No cameras or cell service. “
Not agreed
The court began the offenses in January 2018 and continued until May 2019.
MacDonald frequently follows his victims to restaurant areas, such as a fridge or freezer, a bathroom and a QB for cleaning food trays.
Five teenagers, whose names have been banned from publishing, worked with shift manager MacDonald to override the sink.
He says MacDonald puts his hands on his breast or buttocks while hugging them. Victims never accepted the hugs, and MacDonald said he sometimes hugged without warning.
In one instance, MacDonald told victims he had lost his employee card and joked that it might be one of the girl’s shirts.
Then he came from behind and grabbed the victim’s chest out of her shirt.
McDonald was arrested in August 2020 following a police investigation.
Victim impact statements have been filed
One of the victims told the restaurant owner about McDonald’s behavior.
The lawsuit filed by two of the victims alleges that Wendy’s in Sydney failed to protect herself from repeated sexual harassment and that she was regularly scheduled to work with McDonald’s and other female employees after allegations were leveled against them.
At least two of McDonald’s female colleagues eventually quit because of their behavior.
“It took me a 15-year-old girl to realize that you had done us all wrong.
“I have confidence issues with men now because of what you did. I don’t speak to many people,” said another victim.
The risk of re-offending
In the pre-sentence report, MacDonald said he was not sure why he committed the crimes even though he knew what was wrong.
McDonald’s defense team insisted there was less risk of McDonald’s refund, but McCrory disagreed.
“They continued to abuse the five victims over the course of a year.
MacDonald’s lawyer, Ogemedi Egeriono, told the News he could not comment on the sentencing because he was not informed by his client.
Last month, Matteri asked attorneys on both sides of the case to submit arguments detailing their sentencing recommendation. .
Precedent setting
Crown attorney Peter Harrison said McDonald’s sentence sets a precedent for this type of crime involving children.
“It puts the bar too high even after a guilty plea,” Harrison said. “It has also created a high custody base for first-time offenders, even the first young offenders who abuse the position of trust to commit sexual violence.”
McDurry said MacDonald’s lack of criminal record, supportive family and his plea deal with his decision in the court process was too early.
However, in this case sex offenders need a strong message, he said.
“In our society, no young women who start their first job should be subjected to sexual harassment,” Macri said.
“No parent should worry that their supervisors sexually abuse their child when they leave work.”
MacDonald must complete a 36-month trial period. He is subject to a DNA order and his name will be placed on the national sex offender registry.
