In the last few hours it became known that the First Promiscuous Municipal Court of Malambo (Atlántico) ordered Inpec to transfer, within a period of no more than 72 hours, to the El Forest of Barranquilla to Emilio Tapia.

The court’s decision was given in response to a tutela action filed by Natalia Morales Alzayus, Tapia’s partner, and her two minor children, alleging that they had “violated their rights to family unity, equality and human dignity”, with the decision to transfer Tapia to the Picaleña Prison, in Ibagué, which would have caused an “extreme physical distance”.

The Malambo court, in its decision, argued that Inpec never fully justified Tapia’s transfer and that the change of imprisonment was only ordered after the scandal over the irregular permits that businessman Carlos Mattos, his roommate, had received. /p>

According to the judge’s arguments, it was never stated that Tapia was immersed in irregularities within the prison campus, nor had he committed acts of indiscipline.

In the ruling, it can be read that the claims of Tapia’s partner were granted after “a thorough study of the reasons or support for the denial of transfer requested to Inpec by the plaintiff“. It was concluded that the motivation for the transfer “is insufficient considering that it is only based on security reasons” and it was never defined whether they were related to the inmate, the prison community or any official.

The document also stated that Inpec never issued a statement “regarding the right to family roots. Even when the transfer of the current plaintiff, as indicated, responds to legitimate objectives, it does not indicate the reason for which he is placed in a place of detention that ultimately generates more distance and distance from his family nucleus ”.

Finally, it was noted that Inpec did not consider other alternatives such as transferring him to a prison near the point where his family unit was established, especially considering that “this is made up of two minors and ignoring the repercussion that could fall on them”.

Yesterday, Thursday, June 2, it was learned that the Prosecutor’s Office definitively closed the door to Emilio Tapia so that he would turn on the fan on the millionaire embezzlement of the Centros Poblados case, which was based on the breach of a contract whose value was of 70 billion pesos to provide internet to various rural areas of the country.

According to what the contracting czar had said, would tell how the fraud that meant that contract was planned, as well as the names of those who were involved with this case; however, he was notified of the annulment of the principle of opportunity by not finding an ‘effective collaboration’ with justice.

It is worth mentioning that when this scandal became known and the fact that behind the embezzlement was the business consortium made up of Omega Buildings Constructora S.A.S, ICM Ingenieros S.A.S. and Intec de la Costa S.A.S; The authorities also detected that it was Emilio Tapia, who, through the preparation of false policies, managed to keep the bidding for the millionaire contract.

With his capture, Tapia became the main informant of this case, in fact, seeing the pressure from the Prosecutor’s Office, he had promised to tell the whole truth about the network, in order to be protected under the principle of opportunity.

This maneuver had already been carried out when the hiring carousel exploded in Bogotá. The Cordovan was one of its protagonists, becoming with this the main collaborator to find those who were behind the largest embezzlement that the Colombian capital has had. This served to quickly regain his freedom, but he fell again with the Populated Centers scandal.

For the Prosecutor’s Office, the corrupt businessman did not fulfill the commitment to ‘turn on the fan’, and although he was listened to for several days, he did not provide enough information required to move forward with the investigations.
