The problems of the multi-store are directly related to a dispute with AFP Capital, which asked the retailer compensation for $22,000 million due to the case of unilateral renegotiations 10 years ago.
Again through an essential fact sent to the Commission for the Financial Market (CMF), La Polar referred to the seizure order against him in the midst of his conflicts with AFP Capital: he confirmed that the Santiago Real Estate Registrar received the notification.
The seizure would aim to the parent companylocated at Santa Clara 207, Huechuraba (offices, warehouses, parking lots and personal property; plus some commercial brands and some current accounts), leaving Empresas La Polar S.A. as provisional depository, stated Manuel Vial Claro, president of the board of directors, in the essential fact.
In the same letter, the executive assured that the company is carrying out a series of legal procedures in order to avoid the above and that, for the same reason, “the embargo has not materialized” due to these appeal processes.

“The Company will dedicate itself to finding the best possible solution to safeguard the interests of its collaborators, clients, suppliers and that of its shareholders” ;, stressed Vial Claro.
Foreclosure order against La Polar

At the end of October, also in a communication to the CMF, Vial Claro indicated that the AFP’s claim to collect compensation from the Company for “alleged damages” that occurred as a result of the fraud of the unilateral renegotiations carried out by some executives before the year 2011, constituted “a tremendous injustice”.
& #8220;(…) Since the Company itself is the main victim of fraud, it now sees itself in the eventuality of having to, in turn, assume the patrimonial responsibility derived from those facts”, he stated .
The company remarked on that occasion that it had filed various judicial appeals, which were being processed.
