The defense of the federal deputy Daniel Silveira (PSL-RJ) stated that the congressman acted for “impulse” when requesting diplomatic asylum from the embassies of 4 countries. The lawyers manifested this Wednesday (7.Jul.2021) after the Minister Alexandre de Moraes, of the STF (Supreme Federal Court), demanded explanations about the episode.
The information that the congressman requested diplomatic asylum was revealed by the columnist William Beloved, from the website metropolises. It was not revealed which embassies received the deputy’s requests – all denied the requests. To the STF, Silveira’s defense states that he understands that he was wrong to send the requests.
“In a moment of impulse and on the verge of being restricted from his freedom again, the defendant acted without thinking, however, he recognizes that he acted on impulse and surpassed the logical barrier, as well as, regrets and wants to repair his error”, said Silveira’s lawyers. “However, we still defend that the defendant being restricted from his freedom and removed from his mandate is an exacerbated penalty and is configured in anticipation of penalty, which is inadmissible in our legal system”.
The defense says that the deputy does not behave like “dodge” of Justice and that responds to the STF “without resistance”.

The deputy was arrested for the 1st time in February after releasing a video with attacks on STF ministers and apology for AI-5, the toughest act of the military dictatorship. In March, he was placed under the household regime, but returned to prison last month for failing to pay R$100,000 in bail for violations of the use of electronic ankle bracelets.
In the decision that sent Silveira back to prison, Alexandre de Moraes wrote that the deputy “disrespected the restrictive measures countless times” established with the use of the anklet. The minister stated that the congressman maintained “your total disregard for justice” even after being fined for violations. here’s the whole (167 KB).
The defense took proof of payment of the R$100,000 bail and asked for a return to house arrest. The PGR (Attorney General’s Office) must comment on the case.
