Mobilizations in Asturias against Banco Sabadell’s ERE.CCOO SERVICIOS ASTURIAS / Europa Press
The Ministry of Labor has issued a notice to Banco Sabadell regarding the employment regulation file (ERE) that the entity announced at the beginning of September, and which provides for the dismissal of some 1,900 people. In a letter dated September 21, to which EL PAÍS has had access, the General Directorate of Labor sends an “express warning” to the bank, reminding it that it must “incorporate the necessary debate to develop during the period of consult those measures aimed at avoiding or reducing collective dismissals and mitigating their consequences for the people affected ”.
The letter states that the entity must comply with the formal requirements required by law, but stresses that “it acquires special significance in cases such as the present one,” also respecting the substantive requirements. “In this sense, the business intention, according to the information available to this management center, presents elements of special gravity and significance, particularly due to its impact on employment, which could also affect the groups that currently hold the rates of most worrying unemployment in our country: young people and women ”, reads the letter.

In principle, Sabadell intends to cover the ERE to the greatest extent possible with voluntary departures and early retirement, and will exclude certain groups of workers from layoffs. Among those exempted are workers between 50 and 55 years old, considering that they have greater difficulty accessing the labor market, or those over 63. Sabadell has justified the cut, which will affect more than 12% of the workforce, in the need to achieve greater profitability and efficiency, as set out in its 2021-2023 strategic plan. A motivation that the unions consider an “insult”, especially after measures in this direction had already been agreed at the beginning of this year, with the departure of some 1,800 employees voluntarily. The entity chaired by Josep Oliu, however, claimed that this cut had not been enough to achieve its sustainability objectives.

Labor authorities cannot veto collective dismissals in companies after the 2012 reform, but they can warn of defects in form or lack of documentation in their procedures. Although it is not frequent, there is a very recent precedent. The department led by Yolanda Díaz had already issued the same warning to BBVA and CaixaBank in May, after the two entities launched two workforce reduction processes.
